The short version
Unlike garage-door shops, many states do have pest-specific insurance and/or bond floors tied to the structural pest or pesticide business license. California wants $500k GL + $12,500 bond + WC/exemption. Texas SPCS publishes $500k BI/PD with $1M aggregate (CCC exclusion deleted; ALS-1101 only). Florida splits standard vs fumigation floors and adds WDO E&O. New York DEC pushes a $1M each-occurrence COI path. Arizona wants ≥$500k financial security with chemical endorsements. New Jersey explicitly requires chemical liability equivalent to CG 22 64. Everywhere: license floor ≠ property-manager ask — market practice is still $1M/$2M.
A spray tank does not care about your LLC paperwork. A termite report signed wrong does not care that your “plain” CGL had a pollution exclusion. A property manager’s COI exhibit does not care that your board only asked for $300k.
That’s why pest operators get hit with insurance questions on every serious bid — and why “I’m small, I’ll skip the chemical endorsement” is a lottery ticket you do not want to cash.
Here’s the honest contrast with garage-door insurance posts: pest control actually has a pile of real board floors. Structural pest and pesticide business licenses commonly demand GL, bonds, WC certificates, and — in places like NJ, AZ, GA, and MS — pesticide/pollution wording. Workers’ comp and commercial auto still apply under general employer / motor-vehicle law even when the pest board is silent.

Pollution / pesticide liability & CG 22 64 — what is real
Standard ISO CGL forms often contain a pollution exclusion. Courts and carriers have treated pesticide application claims as pollution in some situations — so a “plain” CGL may not respond the way an operator assumes.
The Insurance Services Office endorsement CG 22 64 (“Pesticide or Herbicide Applicator Coverage”) is a real, commonly cited endorsement that can restore limited coverage for pesticide/herbicide application when operations comply with law/license/label. It is not the same as broad contractors pollution liability.
- New Jersey explicitly requires chemical liability coverage equivalent to CG 22 64 (or equivalent) for pesticide applicator businesses (N.J.A.C. 7:30-7.4).
- Arizona pest-management business financial security, when written as liability insurance, must include endorsements for pesticides/herbicides, fumigation, care/custody/control, rights-of-way, WDIR E&O, and pollution transit for applicable categories (A.R.S. § 3-3615).
- Georgia structural pest insurance form requires pollution liability for sudden/accidental discharge plus E&O for WDO category.
Ask your agent for pesticide/chemical liability — often CG 22 64 or a pollution form. Do not invent that every state mandates CG 22 64 by name. Do invent a phone call to your agent before the next drift claim.
License minimum vs. what customers actually want
Two different games:
- Board / statute floor — keeps your pest / pesticide business license alive (CA $500k, TX SPCS $500k/$1M aggregate, FL $250k/$500k or fumigation $1M/$2M, NC $100k/$300k, OR $25k/$25k, etc.).
- COI ask — what the GC, HOA, property manager, or national account typed into the exhibit. Almost always $1M per occurrence / $2M aggregate, plus additional insured (ongoing + completed ops), primary & noncontributory, waiver of subrogation, and sometimes explicit pesticide/pollution evidence.
Homeowners should ask for proof of liability and WC and verify with the insurer — that’s straight from NAIC contractor scam guidance. A pretty ACORD 25 is evidence, not the policy.
Rule of thumb: Never present $1M/$2M as a “national legal requirement.” It is the market default. Boards can (and do) set lower floors. Contracts can (and do) demand higher — and pesticide endorsements.
High-stakes deep dives
California — SPCB $500k GL + $12,500 bond + WC
Structural Pest Control Board (DCA) — not DPR for structural Branch 1/2/3 company registration. Minimum $500,000 GL (B&P § 8692). Bond $12,500 (B&P § 8697). WC required for company registration or file exemption if no employees subject to WC (B&P § 8693). Branches: 1 fumigation, 2 general pests, 3 wood-destroying organisms. Texas — SPCS $500k / $1M aggregate + CCC exclusion deleted
TDA published rule / form: at least $500,000 BI/PD with minimum total aggregate $1,000,000. Must cover care, custody, or control — CCC exclusion must be deleted. Only ALS-1101 accepted for licensing (no substitute ACORD alone). Occ. Code § 1951.312 still lists lower statutory floors; operators should follow the live TDA SPCS page. Florida — standard vs fumigation vs WDO E&O
Standard business (F.S. 482.071): $250k/$500k BI and PD schedules or $500k CSL. Fumigation as regular ops: $1M/$2M schedules or $2M CSL. WDO inspections (F.S. 482.226(6)): E&O or bond ≥ $250k/$500k, or ≥ $500k equity/net worth with CPA review/audit. Sources: 482.071, 482.226.
New York — DEC $1M each-occurrence COI path
Current DEC application: CGL ≥ $1,000,000 each occurrence, DEC as certificate holder, binders/declarations not accepted. Regulation 6 NYCRR 325.23(g) still lists $300k/$1M BI + $300k PD or bond — follow the live checklist. Sources: DEC business/agency, 6 NYCRR 325.23.
Arizona — ≥$500k financial security + category endorsements
Pest-management business license: financial security ≥ $500,000. License suspends below that floor. Liability-insurance path needs pesticide/herbicide, fumigation, CCC, rights-of-way, WDIR E&O, and pollution transit endorsements for applicable categories. Source: A.R.S. § 3-3615.
Georgia, North Carolina, Virginia, Ohio, Tennessee, Kentucky, Hawaii
GA: household $50k/$50k/$200k aggregate + pollution; WDO $100k/$100k/$500k + E&O. NC: $100k PD / $300k BI or $300k CSL — lapse expires the license. VA: $100k PD / $100k per person / $300k occurrence + 10-day notice. OH: $300k/$300k/$300k completed ops + WDI E&O add-on. TN: $250k/$500k charter + WDO E&O $100k/$300k + structural bonds $50k→$10k. KY: ≥ $1M liability. HI: $100k/$300k + continuous coverage or automatic forfeiture.

Pitfalls that sink pest operators
- “My techs are 1099s” myth. Pest boards and WC agencies often treat field techs as employees. Misclassified “sub” techs can trigger WC premiums, fines, and personal liability after an injury. If they work your routes, wear your shirt, and use your chemicals under your license, treat them as employees until counsel says otherwise.
- LLC does not replace insurance. An LLC may limit some personal business debts; it does not pay medical bills, property damage, or pesticide claims. Boards still require GL/bond/WC. Customers still demand COIs.
- Personal auto for route work. Personal auto policies commonly exclude business use (especially pesticide/chemical haul). Use commercial auto; schedule spray equipment.
- Cancelled or lapsed policy = dead license. Multiple states auto-suspend or expire the pest license when insurance lapses (NC, AZ, HI, GA, WA, OR, TN patterns). Put the state board as certificate holder / notice party where required.
- License minimum ≠ commercial account minimum. Passing a $100k–$500k board floor does not satisfy a property manager asking for $1M/$2M + additional insured + waiver. Bid the insurance you can certificate.
- Plain CGL without pesticide/chemical wording. Pollution exclusions can gut a chemical claim. Ask about CG 22 64 (or equivalent) and/or a pollution/pesticide liability form — required by name or equivalent in places like NJ; effectively expected in AZ/GA/MS.
- WDO / termite report without E&O. Real-estate WDIRs are lawsuit magnets. FL, GA, AL, TN, OH (and others) require separate E&O / inspection coverage for that category.
- Care, custody, control exclusion (Texas lesson). TX SPCS requires the CCC exclusion deleted so customer premises under your control are covered. Tell your agent.
- Umbrella that doesn’t drop down for pesticides. Some umbrellas follow form — including exclusions. Confirm the umbrella actually sits over pesticide/chemical liability.
- Assuming “I have a bond, so I’m insured.” A license bond protects claimants/the board up to the bond amount under bond terms; it is not a substitute for CGL or WC.
Pollution exclusions matter. A “cheap” CGL that excludes pollution can leave you naked on a drift or overspray claim. Ask the agent in writing whether pesticide application is covered — CG 22 64, a pollution form, or something equivalent that the board will accept.
